PA Supreme Court Rules Stormwater Fee an Impermissible Tax
May 14th, 2026On April 30th the PA Supreme Court ruled in West Chester v. Pennsylvania State System of Higher Education that the Borough’s stormwater fee was an impermissible tax rather than a fee. Boroughs with similar fees for storm water management should work with their solicitors to review this case and determine how to proceed.
